Paradise Valley to Change Rezoning Language

The Paradise Valley Planning Commission has approved a staff recommendation to amend the town’s zoning ordinance so it complies with new state legislative requirements on processing rezoning applications.

At its (Jan. 21) meeting, the commission unanimously voted to accept the staff’s recommendations. The issue will go before the town council for final approval in February.

The changes are more of the town doing “administrative clean-up work so that the town code complies with the state legislation,” Planning Commission Chair Pamela Georgelos said.

Last year, the Arizona Legislature passed a bill that reduced the amount of time a municipality has to evaluate whether zoning applications have been properly filed and then issue a decision.

Under the new legislation, a municipality has up to 30 days to determine if an application for rezoning has been properly filled out or has “administrative completeness.”

“That basically just means that we have all the things we need and are necessary to process the application. (We) have all the information on the application, all the supporting materials,” Chad Weaver, the town’s community development director, told the commission.

If the staff determines that the application has not been properly filled out, applicants can refile. After it is refiled, the town has up to 15 days to evaluate the application.
