Short-Term Rental Ordinance Proposals

Short-term rentals and nuisance parties will be back on the May 6 agenda of the Scottsdale City Council’s meeting.

The council has placed two items on its consent agenda to help local law enforcement deal with nuisance parties at short-term rentals, sometimes referred to as vacation rentals.

The first ordinance would make it illegal for promoters to advertise an event as a short-term rental without first getting a city permit. It also gives police officers the ability to clear nuisance parties and makes it illegal for anyone not residing at the address to stay after officers have done so.

A second ordinance would make it illegal for minors to rent a short-term rental.

The proposed moves appear to be popular with the public. A survey done in April shows a 91% approval rating for holding promoters responsible for nuisance parties and unlawful gathering violations. Moreover, 88% of residents agreed that non-residents should not be allowed to stay on a property once police declare a party to be a nuisance. Finally, 96% of residents agreed minors should not be allowed to rent short-term rentals.

The proposed ordinance changes would charge a promoter a minimum fine of $1,000 for a first offense, $1,5000 for a second offense and $2,500 for a third offense in two years for advertising a property for a party without a city permit first. The ordinance would also make it a class three misdemeanor to stay on a property after police have declared the property a nuisance party, and the fine for renting to a minor would be $1,000.
